Key Takeaways

  • Greece approved a 10% tax on annual cryptocurrency capital gains exceeding €500, effective Jan. 1, 2027, with losses eligible for a five-year carryforward.
  • Staking, crypto lending, and DeFi earnings will face a separate 15% income tax, while cryptocurrency inheritances and gifts will receive clarified tax treatment.
  • Investors will have a 12-month window to voluntarily disclose previously unreported crypto gains without penalties or interest, while regulators work to clarify the treatment of crypto-to-crypto swaps.

Greece Adopts Crypto Tax Law

The legislation, approved Thursday, Nov. 5, will take effect on Jan. 1, 2027, and establishes new reporting requirements, exemptions, and provisions allowing investors to declare previously unreported cryptocurrency profits without penalties.

Under the new rules, individuals will pay a 10% tax on annual net cryptocurrency gains exceeding €500 (approximately $560). Gains below that threshold are exempt, but once the limit is exceeded, the entire taxable gain becomes subject to the levy rather than only the portion above €500.

The tax applies to profits from selling cryptocurrencies for traditional currency, as well as using digital assets to purchase goods and services. Contributing cryptocurrencies to a company’s capital also constitutes a taxable transfer under Article 48 of the legislation.

Investors who incur annual net cryptocurrency losses exceeding €500 can carry those losses forward for five years, using them to offset future cryptocurrency capital gains.

The legislation also establishes a separate tax treatment for cryptocurrency income generated through staking, lending, and DeFi activities. Article 47 classifies returns from crypto lending, liquidity provision, yield farming, and participation in blockchain transaction validation as interest income, making them subject to Greece’s 15% tax rate.

When such income is paid in cryptocurrency rather than cash, its taxable value is determined using the asset’s euro-denominated price at the time of the transaction.

Another significant provision gives cryptocurrency investors a 12-month opportunity to voluntarily disclose gains and qualifying crypto income earned before the new rules take effect. Taxpayers who participate can avoid late-filing penalties and interest, provided they pay the taxes owed within 60 days of filing their declarations.

The legislation also clarifies the treatment of cryptocurrency holdings received through inheritance, gifts, and parental transfers, establishing valuation rules based on prices from recognized trading platforms. Cryptocurrency sales are additionally exempted from Greece’s digital transaction tax.

However, uncertainty remains over whether exchanging one cryptocurrency for another will trigger capital gains taxes. While Greece’s Finance Ministry has indicated that crypto-to-crypto swaps will not be taxable, the Greek parliament’s Scientific Service warned that the legislation’s wording could potentially encompass such transactions.

Further regulatory guidance is expected to clarify how the rules will operate.

“Further implementation directives will be published in the coming weeks, which will also define transparency and audit rules,” a senior Finance Ministry official told Reuters.

The official said the government could not reliably estimate how much revenue the new taxes would generate because most Greek cryptocurrency investors use foreign trading platforms, making the domestic market difficult to measure.

The changes come as European countries continue developing different approaches to cryptocurrency taxation. Unlike the European Union’s increasingly unified framework for regulating digital assets, member states retain responsibility for establishing their own tax policies.

According to Reuters, cryptocurrency tax rates across European countries range from approximately 8% to 30%, with most jurisdictions focusing primarily on capital gains.
