The CLARITY Act remains absent from the Senate floor schedule, leaving lawmakers with a shrinking window to advance the crypto market structure bill before the August 10 recess.

CLARITY Act Missing From Senate Floor Schedule

The Senate’s Monday schedule listed action on a spending bill, with no floor time set for the CLARITY Act. The absence raised fresh questions about whether Senate leaders can move the bill before lawmakers leave Washington.

The measure still needs a procedural path before debate can begin. If leadership waits until Wednesday, August 5, to file cloture, the earliest procedural vote could come Friday, August 7.

That vote would not pass the bill. It would only decide whether the Senate should proceed to consider the legislation.

Even if the motion receives 60 votes, senators could still use up to 30 hours of debate. That timeline leaves very little room before the August 10 recess begins.

Senate leaders could shorten the process through unanimous consent or another procedural agreement. That would require broad cooperation and no major objections from senators.

Industry Pressure Grows as Odds Fall

Crypto industry figures have grown frustrated as the bill remains off the public floor calendar. Anthony Scaramucci said the delay raised questions about political strategy before the elections.

“So it now feels like the Republicans don’t want the CLARITY Act to pass so that they can blame the Democrats for not passing it and then seek donations from the crypto industry in the Fall.”

Scaramucci added, “Put this Bill on the floor.” His comments reflected wider concern among market participants watching the narrow Senate calendar.

Prediction market odds have also declined. One trader noted that CLARITY Act odds had fallen to 33%, near a yearly low, as the August recess approached.

The bill’s path remains unclear because senators have not confirmed which version would move forward. Lawmakers could use the House-passed H.R. 3633 or revised Senate text backed by Sen. Cynthia Lummis.

The unresolved process adds pressure to an already tight schedule. Lawmakers must still address disputes over ethics rules, DeFi, stablecoin yields, and market oversight.

SEC and CFTC Rulemaking Could Accelerate

Bernstein analysts said weaker odds for the 2026 CLARITY Act could speed up crypto rulemaking by federal agencies. The firm expects regulators to move more aggressively if Congress fails to pass the bill.

The Securities and Exchange Commission and Commodity Futures Trading Commission could then lean on a backup plan known as Project Crypto. That approach would deliver rules through agency action rather than statute.

Project Crypto could cover token classification, decentralized finance, self-custody, and innovation exemptions. Regulators could also issue guidance on trading platforms and digital asset market conduct.

Agency rulemaking would not carry the same certainty as a federal law. However, regulators could move faster than Congress if the legislative process stalls again.

The CLARITY Act remains the main crypto market structure bill before the Senate. Supporters say the legislation would give clearer roles to regulators and reduce uncertainty for digital asset firms.

The next key moment is whether Senate leaders file cloture by Wednesday. Without faster action, the bill’s chance of advancing before recess will continue to narrow.
