On March 13, Vermont’s Department of Financial Regulation rescinded its “show cause order” against Coinbase, which had alleged that the exchange’s staking service offered unregistered securities. This move comes after the U.S. Securities and Exchange Commission (SEC) dismissed its related case on February 28. The department noted the SEC’s formation of a new task force aimed at providing guidance for cryptocurrency product and service regulation, stating that in light of potential new federal regulatory guidance, rescinding the pending order was deemed most efficient and in the best interests of justice.
In June 2023, following the SEC’s lawsuit against Coinbase, ten U.S. states — including Alabama, California, Illinois, Kentucky, Maryland, New Jersey, South Carolina, Washington, and Wisconsin — initiated legal proceedings, claiming Coinbase’s staking service constituted unregistered securities offerings. In response to Vermont’s recent decision, Coinbase’s Chief Legal Officer, Paul Grewal, urged other states to follow suit, stating, “We have always said: staking services are not securities. We applaud Vermont for embracing progress and providing clarity for its citizens who own digital assets.”
Since the resignation of former SEC Chair Gary Gensler on January 20, known for his stringent stance on cryptocurrency regulation, several SEC lawsuits against crypto firms have been dismissed. Notably, crypto trading firm Cumberland DRW had its case dropped on March 4, and the SEC is reportedly concluding its enforcement action against Ripple Labs after more than four years.

2023년 6월, SEC가 코인베이스에 대한 소송을 제기한 직후, 앨라배마, 캘리포니아, 일리노이, 켄터키, 메릴랜드, 뉴저지, 사우스캐롤라이나, 워싱턴, 위스콘신 등 10개 주가 코인베이스의 스테이킹 서비스가 미등록 증권을 제공했다고 주장하며 법적 조치를 취했다. 버몬트주의 이번 결정으로 코인베이스의 최고법률책임자 폴 그레왈은 다른 주들도 버몬트주의 선례를 따를 것을 촉구하며, “우리는 항상 스테이킹 서비스가 증권이 아니라고 말해왔다. 버몬트주가 진전을 수용하고 디지털 자산을 소유한 시민들에게 명확성을 제공한 것을 환영한다”고 밝혔다.
최근 SEC의 강경한 암호화폐 규제 기조를 보였던 전 SEC 의장 게리 겐슬러가 1월 20일 사임한 이후, SEC의 암호화폐 기업에 대한 소송이 잇따라 취하되고 있다. 암호화폐 거래 회사인 컴벌랜드 DRW는 3월 4일 소송이 취하되었으며, SEC는 4년 넘게 지속된 리플랩스에 대한 집행 조치를 마무리할 것으로 알려졌다.
