South Africa has proposed stricter controls for cross-border crypto transfers under a new draft regulatory manual. The plan would require offshore transfers to pass through authorized providers and reach the central bank. It expands state oversight of digital assets and strengthens reporting across the country’s capital flow system.

South Africa Defines Reportable Crypto Transfers

The National Treasury and South African Reserve Bank released the draft Crypto Asset Manual on Monday. The document explains when digital asset movements become regulated cross-border events under proposed capital flow rules. It also sets procedures for authorization, reporting, administration, and regulatory approval.

A reportable event would occur when crypto moves from a domestic authorized provider to an offshore provider. The same rule would apply when assets move into a privately controlled non-custodial wallet. Authorized providers would report those inflows and outflows to the Financial Surveillance Department.

However, domestic crypto trading would remain outside these cross-border reporting rules. Purchases or sales using rand through local authorized providers would not qualify as offshore movements. South Africa would therefore separate local market activity from transfers moving value beyond national financial controls.

Offshore Transfers Face Tighter Provider Controls

Only individuals could move crypto assets offshore during the initial phase of the proposed system. They would need to use their single discretionary allowance or foreign capital allowance. Direct transfers through unregulated channels would not meet the proposed requirements.

The framework would require users to complete offshore transfers through authorized crypto asset service providers. Regulators would receive transaction information through existing foreign exchange monitoring systems. The approach aims to reduce regulatory gaps and improve detection of illicit financial flows.

South Africa has not classified crypto assets as legal tender or official currency under the proposal. Regulators also have not separated crypto categories because further research remains underway. The central bank instead adopted an activity-based approach focused on purpose, direction, and reporting duties.

Rules Build on Wider Financial Reforms

The manual follows draft Capital Flow Management Regulations published for comment on April 17, 2026. Those regulations proposed bringing crypto assets into South Africa’s foreign exchange control system for the first time. They also introduced authorized providers, declarations, reporting duties, and administrative penalties.

The broader reform would replace exchange control rules dating back to 1961. It would also align South Africa with international standards on financial crime and cross-border transparency. Treasury and the central bank will review comments on both drafts before completing the framework.

Meanwhile, the South African Revenue Service has expanded tax guidance for digital assets. Its draft covers trading, swaps, staking, mining, decentralized finance activity, and crypto payments. Public comments remain open until September 30, while South Africa continues implementing international crypto reporting rules.
